This may prevent the results of such monitoring (recordings, emails, etc.) from being used as evidence in any legal proceedings that may subsequently be brought. The courts recognise employers’ right to use technological tools to monitor work activities in order to ensure the smooth running of the business, but they also place limits on the exercise of these monitoring powers. Employees are provided with information and advice on the limits currently established by the courts to ensure respect for their fundamental rights.

The advice and information provided take into account:

Legal provisions governing the use of technology as a tool for workplace monitoring by employers.

Rulings of the Supreme Court and the Constitutional Court interpreting the legislation and setting conditions for workplace monitoring through technological tools.

The requirements established by the European Court of Human Rights for technological evidence obtained through workplace monitoring to be considered non-infringing of employees’ fundamental rights and therefore admissible in court.

TECHNOLOGY APPLICATIONS

This expertise may be of interest to companies, regardless of their sector, as well as to companies’ legal and employment advisers, trade unions and individual employees.

Beyond the general relevance of this subject, there are two specific situations in which such advice is particularly valuable: (1) when an employer is considering introducing technological mechanisms to monitor work activities, in which case both the employer and employees, individually or collectively, need to understand the limits of lawful monitoring; and (2) when an employer has obtained information through technological workplace monitoring and intends to use it as evidence in legal proceedings, whether in employment proceedings relating to a possible dismissal or in criminal proceedings concerning the possible commission of a criminal offence by an employee.

Employees may also benefit from this expertise if they suspect that their employer is exceeding the limits of its monitoring powers and thereby infringing their fundamental rights. They may take various measures to protect their interests, both in opposing the introduction of monitoring measures and in responding to a possible infringement of their fundamental rights.

All these situations have been studied, analysed and discussed in the various research projects and other work underpinning the expertise now being offered for transfer.

ADVANTAGES AND INNOVATIVE ASPECTS

Employment relationships are complex, involving not only economic interests but also the personal and professional development—in short, the life development—of both employers and employees. Everyone involved in an employment relationship understands that the stronger and more mutually satisfactory the relationship is, the greater and better the results will be, to everyone’s benefit. However, tensions between the two main groups involved—employers and employees—are frequent and sometimes unavoidable.

One common source of tension today is the possibility of employers monitoring employees’ activities to ensure the smooth running of the business. The new technological tools available for this purpose, which are economical, accessible and highly reliable, give employers considerable monitoring capabilities. However, these may conflict with employees’ fundamental rights.

Yet the novelty of these technologies and the speed at which they evolve mean that there is still no clear body of legal doctrine or consistently interpreted legislation in this area.

To help provide solutions to these issues, which are undeniably relevant to our current socio-economic environment, studies have been conducted not only of the applicable legislation but also of how national and foreign courts interpret it. These studies have examined the latest case-law trends of the Supreme Court and the Constitutional Court, as well as the European Court of Human Rights’ interpretation of the requirements that employers’ monitoring of employees must meet for the resulting evidence to be considered lawful.

The findings of the various research projects have been presented, examined and debated at national and international conferences.

DEVELOPMENT STAGE

Maturity level: Fully operational.
